Legal Framework: Consumer Protection (Direct Selling) Rules 2021

The Consumer Protection (Direct Selling) Rules, 2021 entered into on 28th December, 2021. This was a significant measure towards the legalisation and regulation of the direct selling companies in India. Key provisions include: 

  • Direct selling is now clearly defined and recognised by law and is no longer considered a pyramid scheme.
  • The Rules prohibit participation and/or promotion of pyramid schemes and money circulation schemes. 
  • All the direct selling organisations are required to have at least one physical address in India as their registered office. 
  • To authorize the direct seller to sell a product or service, the companies must have a prior written contract with the direct sellers and the terms of the contract shall be just, fair and equitable. 
  • Within 48 hours every consumer complaint should be accepted by a grievance redressal officer and be resolved normally within one month. 
  • Direct sellers must be held responsible for the grievances associated with the sale of goods and/or services by their direct sellers. 
  • All records must be kept for each direct selling entity at the direct selling entity’s registered office, either in hard copy or electronic form. 
  • Each direct selling entity shall designate a nodal person who will be responsible for the compliance of the Act and its regulations. 
  • The companies have to be registered under the GST, FSSAI (food/wellness products) and Companies Act 2013 and Legal Metrology Act 2009.
  • The Rules shall apply to any entity trading in goods/services in India regardless of whether that entity is incorporated in India or not.

How to Verify if a Direct Selling Company is Legal in India

Before going into any of the direct selling companies in India, make sure to check the following points:

  • Look on the official IDSA website at idsa.co.in for the list of IDSA Ordinary Members for membership.
  • Make sure that the company is registered with the Ministry of Corporate Affairs (MCA) with a valid CIN number.
  • Verify that the company is registered for GST – every legal business entity is registered for GST.
  • If the company is involved in food, health supplement or nutrition products, look for FSSAI certification.
  • Check the company website for a compensation plan and income disclosures statement.
  • Ensure that the company has a valid grievance redressal process, and a designated nodal officer.
  • Look for companies that focus more on recruiting than on selling products as they are the ones that have been running a pyramid scheme.
  • Look for the DPIIT (Department for Promotion of Industry and Internal Trade) recognition mark if the company says that it is a startup.
  • Look at consumer reviews on trusted sites and for legal notices or enforcement actions by the state government.
  • Confirm the registered office of the company in India, and its physical presence in India.
